General Terms and Conditions

1. Definitions

In these Terms and Conditions:

• "Services" refers to doula and related services provided by Yael.

• "Client" refers to the individual(s) engaging the services.

• "Agreement" refers to the contract between the Client and Yael, including these Terms and Conditions.

2. Acceptance of Terms

By engaging the services, the Client agrees to these Terms and Conditions in full. If the Client does not agree with any part of these terms, they must not engage in the services.

3. Services Provided

Yael will provide doula services as described in the service package selected by the Client. Services may include prenatal visits, labor support, and postpartum care.

4. Payment Terms

• A non-refundable deposit of [insert amount or percentage] is required upon signing the Agreement to secure services.

• The remaining balance is due by [insert date or milestone].

• Payments can be made via [insert accepted payment methods].

• Late fees may apply if payments are not made by the agreed-upon date.

5. Cancellation Policy

• The Client may cancel the services by providing written notice to Yael.

• For cancellations made more than 30 days before the due date, a refund of [insert percentage] of the balance will be issued.

• No refunds will be issued for cancellations made within 30 days of the due date.

6. Liability

• Yael will provide services with reasonable care and skill. However, the Client acknowledges that childbirth involves inherent risks, and Yael cannot guarantee specific outcomes.

• To the maximum extent permitted by law, Yael is not liable for any loss, damage, or injury incurred by the Client or any person during the provision of services.

7. Confidentiality

• Yael will maintain confidentiality regarding all personal information disclosed during the provision of services, except as required by law or with the Client’s consent.

8. Indemnity

The Client agrees to indemnify and hold Yael harmless against any claims, losses, liabilities, damages, or expenses resulting from the Client's breach of these Terms and Conditions.

9. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.

10. Amendments

Yael reserves the right to modify these Terms and Conditions at any time. Updated terms will be communicated to the Client, and continued use of the services will constitute acceptance of the new terms.

Payment Terms

1. Retainer Fee

• Non-Refundable Deposit: Require a deposit upon signing the contract (50% of the total package price) to secure the booking. This deposit is non-refundable to ensure commitment.

2. Payment Schedule

• Final Payment The remaining balance is due by 34 weeks of pregnancy or 40 days prior to due date, which ever comes first.

3. Payment Methods

• Accept various payment methods for convenience, such as:

  • Bank Transfers

  • Cash

4. Refund Policy

• A partial refund upon cancellation before a specific time frame.

• No refunds after a certain date, especially after your retainer fee is paid.

5. Late Payment Fees

• Late payments will result in termination of contract unless prior arrangments have been made.

6. Cancellation Policy

• Cancellation or rescheduling on the part of the client will result in forfiture of retainer, plus any associated fees.

Sample Payment Terms

• Deposit: A non-refundable deposit of 50% is required to secure a booking.

• Payment Schedule: The remaining balance is due by 34 weeks of pregnancy or 40 days prior to due date, which ever comes first.

• Payment Methods: Payments can be made via cash or bank transfer.

• Cancellation Policy: If cancelled at least 40 days before the due date, a 50% refund of the total package price may be issued.

• If labour extends more then 10 hours, every subsequent hour $150.
